Consultation for Preparing Training Module: Training Module will be suitable for Religious Leaders/Imam

TERMS OF REFERENCE

Background: Domestic violence is one of the most widespread and least recognized rights abuses in the world. Bangladesh is a country where domestic violence rate is very high with almost 60% of women having experienced domestic violence at least one in their lives and over 66% of the victims interviewed had not reported the violence and none of them had sought institutional help. Domestic violence is a daily reality for many women and girl in Bangladesh. Women face considerable impediments to accessing the legal system due to gaps which still exist in the law and deeply rooted notions about gender and violence that persist within society. Critical support services, such as temporary shelter and housing assistance are insufficient and many groups of women are isolated from the services that do exist.Women rights organizations of Bangladesh especially Bangladesh National Women Lawyers’ Association (BNWLA) led an alliance named Citizen Initiative against Domestic Violence urged for security, safety, protection and respectful behavior, legal remedy for dealing with the problems of domestic violence, an easy access to the ordinary courts for such violence to prevent violence against women.Realized the situation of domestic violence Bangladesh government enacted ‘The Domestic Violence (prevention & protection) Act, 2010’ to deal effectively and appropriately with both abuser and the abused. The act empowered the court to make certain orders to protect the victim of domestic violence. The Act has also provided speedy, inexpensive and simple procedures for dispensation of justice relating to the offence of domestic violence.But large group of people and also law enforcing agency, journalists, lawyers, human rights defenders are not aware about the act.  Appropriate & combined action for combating and sustained protection of victims of domestic violence and other human rights abuses requires strengthened capacity and the ability to change stakeholders’ knowledge, attitude and practice. Different   stakeholders should have knowledge on gender issues, cause and effect of domestic violence, laws relating to women rights so that they could take part in a role in protecting women and providing services for survivors.

BNWLA is implementing the ‘Protecting Human Rights Project’ in collaboration with Plan Bangladesh and with the technical assistance of International Centre for Research on Women (ICRW) funded by USAID.

The aim of the project is to reduce the high prevalence of domestic violence and other human rights violations in Bangladesh. The component of the project is Advocacy, Capacity Building, Access to Justice, Survivor Services and Mass Awareness.

As a part of capacity building, BNWLA will provide training to Religious Leaders to build their capacity to identify, investigate, monitor and rehabilitate victims and potential victims of domestic violence.

BNWLA is seeking proposals from individual/firm for developing the training module for Religious Leaders.

 

Terms and Conditions

Task: Prepare training modules on Domestic Violence and Human Rights Laws for Religious Leaders/Imam (course duration: TOT- 04 days and Participants-03days )
Scope to work:
  • Module should be reflected that the training is relevant, participatory, promotes critical self-reflection,
  • Module should be focused conceptual clarity on gender sensitivity and human rights issues, Laws [Domestic Violence (Prevention and Protection Act–2010), & other human rights laws], roles and responsibilities of the participants related to prevention & protection of  domestic violence, Action plan for improving service to domestic violence survivor,
  • The gaps on knowledge, Attitude, Practice (KAP) identified in the baseline survey shall be addressed in the module on priority basis.
  • Consultant will incorporate four days training of trainers schedule and attach TOT complementary handouts for religious leaders training modules.
  • Content of the module will be prepared in consultation with BNWLA team and Plan Bangladesh,
  • The consultant will lead to conduct three days field test training with religious leader.
  • Final draft module will be submitted incorporating feedback of field test training.
  • The paper size of the module should be A4, font will be Times New Roman, size -11, single space,
  • The consultant will submit  03 (three) hard copies and soft copy (MS word and PDF) of the final module
  • The consultant will submit both Bengali and English version of the module,
  • The consultant will submit the proposal in English within 07 (seven) days of the circular.

N.B. The consultant will make her/him available, if anything found to modify the module after finalization.

Time Frame: 74 calendar days of the date of signing of the contract1st Draft Module

  • 1st draft module submission – 25 days of singing contract,
  • Review and share the 1st draft  module – 05 days,
  • Feedback to the consultant for  1st draft  module – 02 days,

2nd Draft and Field Testing

  • 2nd draft module submission – 10 days of getting feedback,
  • Field testing the draft module  – 10 days of getting 2nd draft module,
  • Review and share the findings of  field testing – 05 days,
  • Feedback to the consultant about the findings of field testing – 02

days,

Finalize the Module

  • Final copy submission – 15 days of field testing feedback.

N.B. The consultant will make her/him available,  if anything found to modify the module after finalization,

Eligibility:
  • 7-9 years of proven experience in analyzing and reviewing policies, laws on human rights of Bangladesh.
  • Expertise and experience in developing training manual following adult learning principles, participatory methodologies and conduction of training.
Payment:
  • 20% of total amount will be paid at the time of signing contract,
  • 30% of total amount will be paid at the time of submitting 1st draft,
  • Rest 50% of the total amount will be paid at the time of final module submission.
Clauses:
  • Providing support

BNWLA will provide all kinds of support to the consultant for arranging field test and other support if necessary.

 

  • Disputes

Any dispute or disagreement which can not be resolved by BNWLA Executive Director and Contractor and controversy, claim or dispute otherwise arising out of or in connection with this contract or breach thereof, or the project, shall finally be settled by the Executive Committee of BNWLA.

  • Termination

BNWLA may terminate this contract at any giving written notice to the contractor, if the contractor fails to comply with terms and conditions of the contract (termination for cause). In circumstances other than termination for cause, the contract may be terminated at any time by BNWLA with the consent of the contractor. Both parties must agree on the conditions of termination, including the effective date and, if the termination is partial, the portion of the contract to be terminated. This agreement will be set down in an amending Letter of contract from BNWLA to the contractor.

Upon receipt of and in accordance with a termination notice as specified above, BNWLA shall take immediate action to minimize all expenditure and obligations financed by this contract shall not incur costs after the effective date if termination. In this situation, only working days already fulfilled will be paid to the contractor.

  • Non-Liability

BNWLA does not assume liability for any third party claims for damages arising from this contract.

  • Rights

All Rights are reserved by BNWLA & Plan Bangladesh.

  • Amendment

The contract may deem by written amending letter of contract prepared by BNWLA and concurred by the contractor.

  • Notice

Any notice given by BNWLA or by the contractor must be given in writing and either delivered in person of mailed to BNWLA or contractor addresses used in the Letter of Contract.

  • Confidentiality

Both during and after the end, contractor must not disclose any matters which have come to his/ her knowledge during discharge of his/ her duties or to facts which are manifest to the public or which by their very nature of importance do not require to be treated as confidential.

If the forgoing represents our mutual understanding and agreement, please so indicate by signing and date the two original copies. The copies should be returned to BNWLA. The contractor shall receive one original copy and the other copy will be kept by BNWLA.
